Notice of Application, Public Hearing, and Retained SEPA Environmental Determination

NOTICE IS HEREBY GIVEN that the City of Benton City received a Preliminary Plat application to divide one parcel (~13.28 acres) into 50 lots, extend N. 9th St and Hugh Ave., and develop new internal roads. The proposal is in R-2 district (Medium Density Residential) Stormwater will be contained and infiltrated by a stormwater system within the project site. Public utilities will be extended with the road. Mass grading will occur to prepare buildable lots.

NOTICE OF APPLICATION, PUBLIC HEARING,

AND RETAINED SEPA ENVIRONMENTAL DETERMINATION (DNS)

NOTICE IS HEREBY GIVEN that the City of Benton City received a Preliminary Plat application

to divide one parcel (~13.28 acres) into 50 lots, extend N. 9th St and Hugh Ave., and

develop new internal roads. The proposal is in R-2 district (Medium Density Residential)

Stormwater will be contained and infiltrated by a stormwater system within the project site.

Public utilities will be extended with the road. Mass grading will occur to prepare buildable

lots.

The application was received on February 18, 2022 and resubmitted on May 2, 2022. The

City staff deemed the application was deemed complete on May 16, 2022 and a final

decision will be made on the application within 90 days of that date.

Location of proposal: 46712 N 9th Street, Benton City, WA 99320 (Benton County Parcel

No. 1-0797-205-0005-000). The project is situated in a portion of Section 7, Township 9 N,

Range 27 E, W.M.

NOTICE IS FURTHER GIVEN that the City, determined to be the Lead Agency pursuant to the

State Environmental Policy Act (SEPA) of 1971, as amended, and Washington Administrative

Code (WAC) 197-11, has reviewed the proposal. The City issued a Determination of

Nonsignificance (DNS) for the proposal (annexation, zoning, and subdivision) on September

21, 2022 (SEPA Register 202105111). Since then, the applicant has submitted additional

materials including a geotechnical report, cultural resources survey, and a plat drawing. The

City has reviewed the proposal, as amended, and supplemental environmental information

for probable adverse environmental impacts and has reaffirmed that the proposal will not

have a probable significant adverse impact on the environment, and added findings and

mitigation measures based on the additional materials. The DNS was revised on May 24,

2022. The comment period for the Revised DNS will conclude on June 7, 2022.

The environmental checklist, Geotechnical report, and other materials pertinent to the

proposal are available to the public upon request and have been sent to agencies with

jurisdiction, the Washington State Department of Ecology, and others having an interest in

the proposal.

NOTICE IS FURTHER GIVEN that the Benton City Planning Commission has scheduled a

meeting for Thursday, June 23, 2022 at 6:00 PM at 1009 Dale Ave., Ste A.. During the

meeting the Planning Commission will conduct an open-record public hearing regarding the

Preliminary Plat. All interested parties are invited to participate in the hearing. At the

Planning Commission open record public hearing, comments may be made verbally or in

writing. Following the public hearing, the Planning Commission will make a recommendation

of approval or denial to the City Council based on findings of fact and conclusions of law.

Subsequently, it the City Council will review the record during a closed record hearing which

is anticipated to be scheduled for Tuesday, July 19, 2022 at 7:00 pm, at 1009 Dale Ave.,

Ste A, prior to making a final decision.

If, for any reason, the hearings cannot be commenced or completed on the date specified,

the hearing may be continued to a date certain, place and time without further notice.

These meetings may accommodate virtual as well as and in-person attendance. Please go to

REQUEST FOR COMMENT

You may provide written comments on the proposed preliminary plat, receive notice of and

participate in hearings, and request a copy of the decision. Send written comments or

requests for further information to the City Clerk, P.O. Box 70, Benton City, WA 99320 or

with the email / phone information listed above. Written materials should be submitted by 5

pm on June 15, 2022 for inclusion in the Planning Commission’s staff report. THIS IS

SEPARATE FROM THE DNS (ENVIRONMENTAL IMPACT) COMMENT PERIOD LISTED ABOVE.

the State of Washington and all other applicable laws that may require release of

documents to the public.
